NGO & Trust Registrations

A Trust is formed by a Trust Deed under the Indian Trusts Act, managed by trustees. A Society is registered under the Societies Registration Act, governed by a managing committee. A Section 8 Company is incorporated under the Companies Act 2013 for charitable objects. All three can obtain 12A and 80G registrations.
While not legally mandatory, 12A registration is practically essential. Without it, your NGO's income (including donations) is taxable at normal slab rates. With 12A, all surplus applied to charitable purposes is fully exempt from income tax, making it critical for most non-profits.
Donors contributing to an 80G-registered NGO can claim a deduction of 50% or 100% of the donated amount from their taxable income (subject to qualifying limits). This significantly incentivises donations and makes your NGO more attractive to corporate and HNI donors.
Any NGO, Trust or association that wishes to receive donations or funding from foreign sources (including NRIs abroad, foreign organisations or foundations) must obtain FCRA registration from the Ministry of Home Affairs. Receiving foreign funds without FCRA is a criminal offence.
CSR registration (Form CSR-1 on MCA portal) is required for NGOs, Trusts and Section 8 companies that wish to receive Corporate Social Responsibility funds from companies. The NGO must be established at least 3 years before applying and must operate in CSR-eligible activity areas.
Annual compliance typically includes: filing ITR-7 with the Income Tax Department, submitting Form 10B (annual statement for 12A / 80G), filing FCRA annual return (FC-4) if FCRA registered, and maintaining proper books of accounts audited by a CA. Failure to comply can lead to cancellation of exemptions.
